Lease Agreement

1. TENANT ELIGIBILITY AND OCCUPANCY

The Tenant must be at least eighteen (18) years old (referred to as an "adult") and will occupy the unit for the entire duration of the reservation. Other authorized occupants may include family members or friends of the Tenant. Access to the premises will be restricted to these authorized individuals. Any unauthorized persons found occupying or using the premises will result in immediate termination of the agreement without a refund. Keys will only be issued to adults upon presentation of a valid government-issued ID.


2. RESERVATIONS

  • All times are in Standard Time Zones in the U.S. and all transactions are in U.S. Dollars (USD), unless otherwise specified.
  • Refund Policy: No refunds will be provided for early departures unless the leased property or its premises are deemed uninhabitable (e.g., fire, flood, or other catastrophic events). The Owner or Agent will review requests based on reasonable grounds and negotiate a fair and equitable refund if applicable. The cancellation policy for the full refund is displayed in the description page of the property.
  • Tenants are strongly advised to obtain vacation insurance to cover unforeseen circumstances.

3. HAZARDOUS PRACTICES

  • Open flames, including candle burning, are strictly prohibited on balconies and within the unit.
  • Tampering with or disabling smoke detectors is strictly prohibited and will result in penalties.
  • To prevent accidental activation of smoke alarms, always use the overhead stove fan while cooking.

4. PET AND ASSISTANCE ANIMAL POLICY

  • Pets are not permitted unless explicit permission has been granted by the Owner or Agent. Evidence of unauthorized pets will result in immediate termination of the agreement without a refund.
  • Assistance animals are not considered pets and are allowed without additional fees, provided documentation is supplied if required by the Owner or Agent.
  • House Rules for Animals:
    1. Identification: Animals must wear a collar or harness with the owner’s contact information.
    2. Supervision: Animals must not be left unattended at any time.
    3. Control: Animals must be leashed or under control of verbal or sight commands.
    4. Waste Cleanup: Animal waste must be cleaned up immediately and disposed of in outdoor trash bins.

5. FAMILY RENTAL ONLY

Reservations made by teenagers or groups of young individuals will only be accepted if accompanied by an adult (aged 18 or older) who must remain in the unit throughout the stay. Violation of this policy will result in immediate eviction and forfeiture of all payments.


6. NONSMOKING POLICY

  • Smoking, including vaping or electronic cigarettes, is strictly prohibited within the property.
  • Evidence of smoking will result in forfeiture of the security deposit and additional charges for cleaning, deodorizing, and repairs.

7. SLEEPING CAPACITY AND DISTURBANCES

The Tenant and all occupants will forfeit the rental fee and security deposit if:

  1. The maximum occupancy or sleeping limit of the property is exceeded.
  2. Illegal activities occur on the premises.
  3. Damage is caused to the rental property or neighboring properties.
  4. Actions disrupt the peace and quiet enjoyment of neighbors.

8. UTILITIES

  • No compensation will be provided for temporary outages of electricity, gas, water, cable, or telephone services.
  • Outages will be reported immediately, and every effort will be made to restore service as quickly as possible.

9. POOL AND PATIO SAFETY

  • Use of the pool, patio, or deck is at the Tenant's own risk. These areas may become slippery when wet.
  • Children must not use the pool area without adult supervision.

10. MAINTENANCE

  • Tenants should promptly report maintenance issues to the Owner or Agent for resolution.
  • No refunds will be issued for maintenance-related inconveniences, including issues with heating, air conditioning, appliances, or other amenities.
  • The property must be returned in the same condition as at check-in. Excessive mess or damage may result in deductions from the security deposit or additional charges if repair costs exceed the deposit.

11. HOLD HARMLESS CLAUSE

To the fullest extent permitted by law, HandalStay, the Owner, and the Agent of the Owner shall not be held liable for any loss, damage, or injury to persons or personal property. This includes, but is not limited to, inconvenience, weather conditions, natural disasters, acts of God, or circumstances beyond their control.


12. PARKING

Parking of boats, jet skis, trailers, and recreational vehicles (RVs) is prohibited on the premises unless explicitly approved by the Owner or Agent.


13. ADDITIONAL TERMS AND CONDITIONS

  • The Tenant agrees to release HandalStay, the Owner(s), and the Agent from all claims, liabilities, or demands arising from injury, loss, or damage incurred during the stay.
  • In the event of legal action related to this agreement, the prevailing party shall recover reasonable attorney's fees and costs.

14. ENTRY BY OWNER

The Owner(s) or their Agent may enter the premises under the following conditions: in case of an emergency, to conduct necessary or agreed-upon repairs, alterations, or improvements, to provide agreed-upon services, or to show the property to potential buyers, renters, or contractors. Except in cases of emergency, the Owner(s) or Agent will provide the Tenant with at least 24 hours' notice prior to entry.


15. CREDIT CARD AND PAYMENT AUTHORIZATION

  • By providing credit card information, the Tenant consents to charges for all reservation-related fees, incidental charges, and additional fees.
  • Other Payment Methods: Payments via PayPal, Apple Pay, Google Pay, Zelle, or Venmo are irrevocable and governed by the same terms. Disputes or chargebacks must be resolved directly with HandalStay, the Owner, or Agent.

16. ADDITIONAL PROVISIONS

Matters not addressed in this lease agreement shall be governed by the Terms of Service and the Privacy Policy of HandayStay.
